NAKO TATTOO

Privacy Policy

Nako Tattoo ("Nako," "we," "us," or "our") values our clients and website visitors and respects their privacy. This Privacy Policy ("Privacy Policy") governs our collection and use of data in connection with our website located at www.nakotattoo.com (the "Platform"), our tattoo and consultation services (the "Services"), and any communications with us, including via WhatsApp and Instagram.

This Privacy Policy sets forth the nature, purpose, use and sharing of any Personal Information. "Personal Information" or "Personal Data" as used in this Privacy Policy means information that can be used on its own or with other information to identify, contact, or locate you. This includes your name, physical address, email address, telephone number, payment information related to deposits, Instagram or WhatsApp handle, and other identifying information. It may also include health-related information you voluntarily share with us that is relevant to the safety of your tattoo session (for example, allergies or skin conditions).

We may collect Personal Information directly from you when you visit the Platform, message us, or book and attend a session with us.

This Privacy Policy does not govern the privacy practices of third-party websites or platforms, such as WhatsApp, Instagram, Google Maps, or our website hosting provider (Tilda), which have their own privacy policies. We are not responsible for the content or privacy practices of third-party platforms to which the Platform may link or through which our Services are booked. You should review the privacy policies of such platforms separately.

Please read this Privacy Policy carefully so that you have a clear understanding of how we collect, use, and protect your Personal Information in connection with your use of the Services. IF YOU HAVE OBJECTIONS TO THIS PRIVACY POLICY, YOU SHOULD IMMEDIATELY DISCONTINUE USE OF THE PLATFORM AND SERVICES AND FOLLOW THE PROCEDURE DESCRIBED IN THE SECTION ENTITLED "YOUR PRIVACY RIGHTS."

Changes in Privacy Policy

Any Personal Information that we collect and maintain will be subject to this Privacy Policy, as amended from time to time. We may change this Privacy Policy at our sole discretion. If we make material changes, we will notify you by posting an updated Privacy Policy on the Platform with a revised "Last updated" date. If, as a result of such changes, you want to alter the ways in which we may use your Personal Information, you may do so by following the procedure described in the section entitled "Your Privacy Rights."

Collection of Information

We collect information from you in a few ways: information you choose to give us, information we obtain through your use of our Services, and, occasionally, information from third parties. Each is detailed below.

Information you provide directly. When you contact us to request a consultation or book a session — whether through WhatsApp, Instagram, or the Platform — we collect the Personal Information you choose to share, including your name, phone number, email address, Instagram handle, tattoo ideas, reference images and photos, placement and size preferences, and any health-related information relevant to your session (for example, allergies, skin conditions, or medication use). We also collect payment information when you pay a deposit to secure your appointment; this is processed through third-party payment providers, and we do not store full payment card details.

Information collected automatically. When you visit the Platform, we and our hosting provider (Tilda) may automatically collect certain non-personal, technical information, including device and browser type, operating system, referring or exit webpages, pages visited, and your general location based on IP address. This information is generally collected in aggregate form and is used to understand how visitors use the Platform and to improve it.

Information from third parties. We may occasionally supplement the information you provide with information available through WhatsApp or Instagram (such as your profile handle or display name) to help us identify and communicate with you more easily.

How Your Information Is Used

We collect and use your Personal Information only for legitimate business purposes related to our tattoo studio. We may use, store, and process your information to:

Respond to consultation requests and communicate with you about your tattoo idea, pricing, and availability.

Schedule, confirm, reschedule, or cancel appointments.

Prepare custom sketches and designs based on the references and ideas you share with us.

Process deposits and payments for booked sessions.

Send appointment reminders, preparation instructions, and aftercare guidance.

Maintain hygiene, safety, and appointment records as required by New York State health regulations.

Understand how visitors use the Platform in order to improve it.

Comply with applicable law, or respond to lawful requests from courts or government authorities.

Fulfill another legitimate business interest, when not overridden by your privacy interests or rights.

When you separately consent to it — for example, if we ask permission to feature a photo of your finished tattoo on our Instagram or portfolio.

We do not use your Personal Information for automated decision-making, and we do not use your health-related information for any purpose other than safely providing your tattoo session.

Tracking, Cookies, and Similar Technologies

Our Platform is built on the Tilda website platform, which may use cookies or similar technologies to ensure basic site functionality and, where enabled, to collect anonymized analytics such as page visits and general traffic patterns. Most browsers are initially set to accept cookies. You can set your browser to notify you when a cookie is being placed, or to refuse cookies altogether. We do not support browsers' "Do Not Track" signals, but you may enable or disable this feature through your own browser settings. If you disable cookies, some features of the Platform may not function properly.

We do not use cookies for third-party advertising or ad retargeting, and we do not use tracking technologies to sell your Personal Information.

Protecting Your Information

We use reasonable technical and organizational security measures to help protect your information, including relying on reputable, secure third-party platforms for website hosting, messaging, and payment processing, and restricting access to client information to Nako and authorized staff only. We do not retain your Personal Information for longer than necessary for the purposes described in this Privacy Policy, including any hygiene and safety record-keeping obligations under New York State law. When we no longer need your Personal Information, we take reasonable steps to dispose of it securely.

No method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security of your information.

Disclosure to Third Parties

We do not sell your Personal Information, and we will not share it with third parties without your consent, except in the limited circumstances described below:

Service providers. We may share information with trusted third-party service providers who help us operate our business, including our website host (Tilda), messaging platforms (WhatsApp/Meta, Instagram/Meta), and payment processors used to collect deposits. These providers only receive the information necessary to perform their services and are expected to protect it accordingly.

Legal requirements. We may disclose your information if required to do so by law, subpoena, or governmental request, or where necessary to protect our rights, safety, or property, or the rights and safety of others.

Business transfers. If we sell, transfer, or merge all or part of our business, client information may be transferred as part of that transaction. We will make reasonable efforts to notify you of any such change.

We do not share your reference photos, tattoo designs, or finished tattoo photos publicly (including on Instagram or our portfolio) without asking for your consent first.

International Transfers

Our Services are intended for clients located in the United States, and our studios operate exclusively in New York. If you contact us or use the Platform from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States, which may not have data protection laws equivalent to those of your home country. By using the Platform or Services, you consent to this transfer.

Depending on applicable law, you may have certain rights with respect to your Personal Information, including the right to:

Request access to the Personal Information we hold about you.

Request correction of inaccurate or incomplete Personal Information.

Request deletion of your Personal Information, subject to any legal or record-keeping requirements (for example, hygiene and safety records required under New York State law).

Withdraw consent at any time where processing is based on your consent (for example, using your photos for our portfolio or Instagram) — this will not affect the lawfulness of any prior processing.

Object to processing of your Personal Information based on our legitimate interests.

Opt out of promotional or marketing communications at any time.

**California residents:** If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA/CPRA), including the right to know what categories of Personal Information we collect and the right to request deletion of that information. We do not sell Personal Information, and we do not discriminate against you for exercising any of your privacy rights.

To exercise any of these rights, please contact us using the details in the "How to Contact Us" section below. We will make a good-faith effort to respond to your request as soon as reasonably possible, though certain requests may be subject to legal or record-keeping limitations.

Your Choices

If you no longer wish to receive communications from us, you may opt out at any time by messaging us directly on WhatsApp or Instagram, or by emailing us using the contact details below. Please note that we may still need to contact you regarding an active or upcoming appointment.

You may also control cookies through your browser settings, as described in the "Tracking, Cookies, and Similar Technologies" section above.

Children's Privacy

Our Services are intended for adults. Tattoo services are provided only to clients who meet the legal age and consent requirements under New York State law, and we do not knowingly collect Personal Information from individuals under 18 through the Platform. If we learn that we have inadvertently collected information from a minor without proper consent, we will delete it.

Governing Law

The terms of this Privacy Policy are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. By using the Platform or our Services, you consent to the application of New York and United States law, and to the collection, use, and disclosure of your information as described in this Privacy Policy.
